Le travail des ressortissants étrangers

Textes applicables :

Selon sa nationalité, les conditions de son entrée et les motifs de son séjour en France, un étranger sera autorisé ou non à exercer une activité professionnelle.

Il faut distinguer 4 situations :

  • Celle de l’étranger qui vient en France pour y travailler.
  • Celle de l’étranger qui est en séjour régulier en France mais dont le titre de séjour ne l’autorise pas à travailler.
  • Celle de l’étranger qui est en séjour irrégulier en France mais qui dispose de perspectives d’embauche.
  • Celle de l’étranger étudiant qui souhaite travailler en France.

Un étranger ne peut venir travailler en France que s’il a obtenu une autorisation au préalable et c’est généralement le futur employeur qui s’occupe des démarches en entamant une procédure d’introduction d’un salarié étranger.

L’étranger peut venir en qualité de travailleur saisonnier ou permanent, cadre de haut niveau, etc. et obtenir le titre de séjour correspondant.

Pour travailler régulièrement en France l’étranger doit être titulaire soit :

– d’une autorisation de travail délivrée par le Préfet (la demande est à déposée via le téléservice de l’administration numérique des étrangers en France – ANEF : https://administration-etrangers-en-france.interieur.gouv.fr/particuliers/#/)

– d’un titre de séjour autorisant le travail en France : carte de résident, carte vie privée et familiale etc.

Si le titre de séjour n’autorise pas à travailler, il est nécessaire de demander un changement de statut.

Travailler sans autorisation est un délit puni d’une amende de 15 000 euros et d’une peine d’emprisonnement de 5 ans.

MAIS

Il existe une possibilité d’admission exceptionnelle au séjour depuis le 18 janvier 2008 notamment pour les étrangers titulaires d’une promesse d’embauche portant sur certains métiers où il existe des difficultés de recrutement.

Cette procédure a été précisée dans la circulaire du 28 novembre 2012.

Un étudiant étranger a l’autorisation de travailler 964 heures dans l’année ce qui équivaut à un contrat d’une durée de 20 heures hebdomadaires.

Pour les étudiants algériens, il est possible de travailler à hauteur de 50 % de la durée de travail annuelle mais une autorisation provisoire de travail doit être demandée auprès des services de la Préfecture via l’ANEF.

  • Le futur employeur doit faire publier une offre d’emploi auprès du Pôle emploi mais la situation de l’emploi est opposable (sauf pour les métiers « en tension ») et il ne doit pas y avoir de main d’œuvre disponible et qualifiée pour le poste.
  • Si l’offre n’est pas satisfaite, une attestation est remise par le Pôle emploi et une demande d’autorisation de travail peut être sollicitée via le téléservice de l’ANEF.
  • Si les services de la Préfecture accorde l’autorisation de travail, le dossier est transmis à l’OFII (son siège à Paris ou ses délégations dans certains pays comme le Maroc, la Tunisie ou la Turquie) qui organise la venue de l’étranger en France : le dossier est transmis à l’ambassade pour la délivrance du visa et une visite médicale est réalisée lors de l’arrivée en France notamment.
  • Un visa valant titre de séjour d’un an sera délivré. Il portera la mention « salarié » si la personne concernée dispose d’un contrat à durée indéterminée, la mention « travailleur temporaire » si la personne dispose d’un contrat à durée déterminée, ou « détaché » pour les travailleurs détachés. Les ressortissants algériens ne sont pas visés par cette disposition.
  • L’employeur devra ensuite verser une cotisation dont le montant varie selon la durée du contrat et la rémunération.
  • L’étranger adresse sa demande de changement de statut à la préfecture : il devra joindre une demande d’autorisation de travail établie par l’employeur.

C’est l’employeur qui devra fournir la plupart des documents exigés.

  • Les services de la Préfecture examineront si l’autorisation de travail peut être délivrée ou non. La demande est à déposée via le téléservice de l’ANEF.

Si la demande est acceptée, un titre de séjour sera délivré :

  • Il portera la mention « travailleur temporaire » si le contrat est à durée déterminée.
  • Il portera la mention « travailleur salarié » si le contrat est à durée indéterminée.
  • L’employeur devra ensuite verser une cotisation dont le montant varie selon la durée du contrat et la rémunération.

L’étranger devra produire une promesse d’embauche ou un contrat de travail (prioritairement CDI ou CDD d’au moins 6 mois), résider en France depuis 5 ans, justifier d’une bonne intégration et d’une expérience professionnelle antérieure.

La situation de l’emploi n’est pas opposable pour les métiers figurant dans les listes de métiers en annexe des accords de gestion concertée des flux migratoires que la France a conclu avec certains pays tels que le Bénin, le Burkina-Faso, le Cap-Vert, le Congo, le Gabon, l’Ile Maurice, la Russie, le Sénégal ou la Tunisie et des dispositions spécifiques sont également prévues pour les jeunes professionnels : pour en savoir plus, http://www.immigration-professionnelle.gouv.fr

Le travailleur étranger devra également fournir les justificatifs prévus par l’arrêté du 10 octobre 2007.

Il appartient à l’employé de faire les démarches de demande d’autorisation de travail auprès des services de la préfecture de son lieu de résidence.

L’employeur devra ensuite verser une cotisation dont le montant varie selon la durée du contrat et la rémunération.

Les ressortissants algériens et tunisiens ne peuvent pas, a priori, bénéficier de cette mesure de régularisation.

PENDANT LES ÉTUDES

  • L’employeur doit déclarer auprès de la préfecture l’embauche de l’étudiant au moins deux jours ouvrables avant le début du contrat de travail.
  • Cette formalité est accomplie soit par lettre datée, signée et recommandée avec avis de réception, soit par courrier électronique.
  • Si l’étudiant étranger dépasse la limite fixée par la loi pour travailler, son titre de séjour pourra lui être retiré.

 

APRÈS LES ÉTUDES

  • Si l’étudiant obtient un diplôme équivalent à un Master II, il peut demander un changement vers une carte de séjour « recherche d’emploi ou création d’entreprise » ou une autorisation provoire de séjour prévue par un accord international.
  • Sinon, l’étudiant peut solliciter un changement de statut auprès de la préfecture selon les critères posés par
    la circulaire du 31 mai 2012.

حسب جنسيته وشروط دخوله وأسباب إقامته في فرنسا، سيرخص للأجنبي بممارسة نشاط مهني أو سترفض له هذه الرخصة

– حالة الأجنبي الذي يأتي إلى فرنسا ليشتغل فيها.
– حالة الأجنبي المقيم في فرنسا بصفة شرعية إلا أنه يملك وثيقة إقامة لا تسمح له بأن يشتغل.
– حالة الأجنبي المقيم في فرنسا بصفة غير شرعية وأمامه إمكانيات تشغيل.
– حالة الطالب الأجنبي الذي يرغب في الاشتغال في فرنسا.
إن الجدول التالي يلخص القواعد والإجراءات المطابقة لكل حالة من هذه الحالات.

 

القواعد المعمول بها لكل حالة:

 للطالب الأجنبي الحق في أن يشتغل 964 ساعة في السنة وهو ما يعادل عقداً مدته الأسبوعية 20 ساعة.
يحق للطلبة الجزائريين العمل نصف المدة السنوية القانونية ولكن بعد الحصول على رخصة يطالب بها لدى مديرية الشغل (« ديراكت »).

إن العمل بدون رخصة يعتبر جنحة تعاقب بغرامة 15000 يورو وبالسجن لمدة 5 سنوات.
لكن
هناك منذ 18 يناير 2008 إمكانية تسوية بالنسبة للأجانب الحاملين لوعد بالتشغيل يخص بعض الحرف التي يصعب فيها التوظيف.

لقد تم تفصيل هذه الإجراءات بموجب المنشور المؤرخ في 24 نوفمبر 2009 والملحق المؤرخ في 18 يونيو 2010

ليشتغل بصفة شرعية في فرنسا، على الأجنبي أن يكون حاملاً:
– لوثيقة إقامة تسمح العمل في فرنسا: بطاقة المقيم، بطاقة الحياة الخاصة والعائلية، الخ.

– إذا كان سند الإقامة لا يرخص بالعمل، يجب المطالبة بتغيير الوضع.

لا يمكن للأجنبي أن يأتي إلى فرنسا ليعمل فيها إلا إذا كان قد حصل مسبقاً على رخصة. ويعود عادة لمن سيكون مستخدمه القيام بالمساعي اللازمة بفضل إجراءات إدخال الأجير الأجنبي.

يمكن للأجانب أن يأتوا بصفة العمال الفصليين أو الدائمين أو ككوادر ذوي المستوى العالي، الخ. وأن ينالوا وثيقة الإقامة الملائمة.

 

الإجراءات المعمول بها لكل حالة:

خلال الدراسة

– على المستخدم أن يخبر العمالة بتشغيل الطالب على الأقل يومين عمل قبل بداية تنفيذ عقد العمل.
– ويتم هذا الإجراء عن طريق رسالة مؤرخة، موقعة وموصى على مع إفادة الاستلام أو عن طريق البريد الإلكتروني.

– إذا تجاوز الطالب الأجنبي الحد القانوني للعمل، يمكن أن تسحب منه وثيقة الإقامة.

بعد الدراسة

– إذا نال الطالب شهادة تعادل شهادة الماستر 2، عليه أن يطلب، 4 أشهر قبل انتهاء وثيقة الإقامة كطالب، رخصة عمل مؤقتة مدتها 6 أشهر من أجل تجربة أولى في فرنسا: إذا عُرض عليه شغل لوقت كامل له علاقة مع دراسته، يجب أن يطلب تغييراً لوضعه في ظرف 15 يوماً بعد بداية العقد.
– وإلا، يمكن للطالب أن يطلب تغيير الوضع لدى العمالة وهو الأمر الذي بات أصعب منذ المنشور المؤرخ في 31 مايو 2011.

يجب على الأجنبي أن يقدم اقتراح عقد عمل ذي مدة غير محددة (أو بصفة استثنائية عقد ذي مدة محددة لا تقل عن سنة) يخص إحدى الحرف الـ14 المذكورة ضمن القرار المؤرخ في 11 أغسطس 2011 أو حرفة « تحت الضغط »، كما يجب عليه أن يكون مقيماً في فرنسا منذ 5 سنوات وأن يثبت اندماجه وخبرة مهنية سابقة.

تنص الاتفاقات الثنائية المبرمة مع البينين وغابون والسينغال وتونس على تعديلات لقائمة الحرف هذه.

على العامل الأجنبي أن يقدم أيضاً كل الإثباتات المنصوص عليها ضمن قرار 10 أكتوبر 2007.

على المستخدم أن يقوم بالمساعي للحصول على رخصة العمل لدى مصالح العمالة التي يتبع لها محل إقامته ملتمساً من العامل حسن الالتفات.

على المستخدم أن يسدد بعد ذلك اشتراكاً يختلف مبلغه حسب مدة العقد والأجر.

لا يمكن للرعايا الجزائريين الاستفادة من هذا الإجراء.

  يرسل الأجنبي مطالبته بتغيير الوضع إلى العمالة. ويحتوي الملف على طلب رخصة عمل من إنجاز المستخدم الذي سيوفر أهم الوثائق المطلوبة.
ستفصل مديرية « ديراكت » في إمكانية تسليم رخصة العمل.
إذا تم قبول الطلب، ستسلم وثيقة إقامة:
– ستحمل بيان « عامل مؤقت » إذا كانت مدة العقد أقل من 12 شهراً.
ستحمل بيان « عامل أجير » إذا كانت مدة العقد تساوي أو تفوق 12 شهراً.
يجب بعد ذلك على المستخدم أن يسدد اشتراكاً يختلف مبلغه حسب مدة العقد والأجر.  

– يجب على من يسعى لأن يكون مستخدماً نشر عرض تشغيل لدى « قطب الشغل » لكن وضع الشغل له صفة المحتج به (ما عدا بالنسبة للحرف التي هي « تحت الضغط ») ويجب ألا يكون هناك يد عاملة متوفرة ومؤهلة للمنصب.

– إن لم يتم تلبية العرض، فستسلم شهادة من قبل « قطب الشغل » ويجوز إيداع الملف لدى مديرية « ديراكت ».

– إذا منحت مديرية « ديراكت » رخصة العمل، يحول الملف إلى الديوان الفرنسي للهجرة والإدماج (« أوفي »)، الذي له مقره بباريس ومفوضات في بعض البلاد منها تونس والمغرب وتركيا، لينظم قدوم الأجنبي إلى فرنسا: تحويل الملف إلى السفارة لتسليم التأشيرة، الفحص الطبي عند الوصول إلى فرنسا، الخ.

– سيحمل سند الإقامة بيانات مختلفة حسب مدة العقد وطبيعة التشغيل: « أجير »، « عامل مؤقت »، « عامل فصلي »، الخ.

– على المستخدم أن يؤدي بعد ذلك اشتراكاً يختلف مبلغه حسب مدة العقد والأجر.

Applicable texts:

Depending on the nationality, the entry conditions and the motives for residence in France, a foreigner will or will not be authorized to practice a professional activity.

These 4 situations must be distinguished from each other:

  • That of the foreigner who comes to France to work there;
  • That of the foreigner who is legally permitted to be in France, but whose residence permit does not authorize employment;
  • That of the foreigner who is illegally residing in France but who has employment prospects;
  • That of the foreign student who wishes to work in France.

A foreigner can only come to France to work if he/she has obtained a preliminary authorization and it is generally the future employer who completes these steps due to the introductory procedure of a salaried foreigner

The foreigner can come as a seasonal or permanent worker, possessing a high level etc. and obtain the corresponding residence permit

To legally work in France the foreigner must have either:

-an employment authorization issued by the Digital administration of foreigners in France (ANEF)

-a residence permit authorizing employment in France: residence permit, residence permit for private and family purposes etc.

If the residence permit does not authorize employment, a change of status must be requested

Working without authorization is a crime punishable by a 15,000 euro fine and a 5 year prison sentence

BUT

There is a possibility for regularization since January 18, 2008 for foreigners having employment prospects for certain professions where there are recruitment difficulties

This procedure was clarified in the November 24, 2009 circular and the addendum from June 18, 2010

A foreign student is authorized to work up to 964 hours of the year which is equivalent to a period of 20 hours per week

For Algerian students, it is possible to work up to 50% of the annual work period but a provisional work authorization must be requested with the Prefecture through the digital administration of foreigners in France (ANEF).

 

The applicable procedures for each situation

  • The future employer must have an employment offer published with the employment office but the employment situation is opposable (except for “jobs with many vacancies” professions) and there must not be an available worker who is qualified for the position
  • If the offer isn’t satisfied, an attestation is given by the employment office and the application can be filed with the Prefecture through the digital administration of foreigners in France (ANEF).
  • If the Prefecture grants the employment authorization, the application is transferred to OFII (French Office for Immigration and Integration) (its Paris headquarters or its delegation in certain countries like Morocco, Tunisia or Turkey) that organize the foreigner’s coming to France: transferring the application to the embassy to issue the visa, medical examination upon the arrival in France etc.
  • The residence permit will bear different mentions according to the length of the contract and the nature of the employment
    « salaried », « temporary worker », « seasonal worker » etc.
  • The employer must then pay a contribution whose sum varies according to the length and average earnings of the contract
  • The foreigner addresses her/her request for a change of status at the Prefecture: he/she must include a request for employment authorization provided by the employer. It is up to the employer to provide most of the requested documents
  • The Prefecture will decide if the employment authorization can or cannot be issued

If the request is accepted, a residence permit will be issued:

  • It will carry the mention « temporary worker” if  it is a open-ended contract.
  • It will carry the mention « salaried worker » if it is a fixed-term contract

The employer must then pay a contribution whose sum varies according to the length and average earnings of the contract

The foreigner must produce a proposition of a work contract for an indeterminate period (or exceptionally a contract determined for at least 1 year)
bearing one of the 14 professions concerned in the decree from August 11, 2011 or a job with many vacancies,

WHILE STUDYING

The employer must declare at the Prefecture the hiring of the student at least two business days before the beginning of the work contract

This formality is fulfilled either by certified signed and dated mail, or by e-mail

If the student exceeds the limit established by the law to work, his/her residence permit could be revoked from him/her

 

AFTER STUDYING

If the student obtains a degree equivalent to a Master II, he or she can request a change to a « job search or business creation » residence permit or a temporary residence permit provided for by an international agreement.

Otherwise, the student must request a change in status with the prefecture : which has been made more difficult since the circular from May 31, 2011

 

Ce visa permet à un étranger souhaitant étudier en France dans un établissement d'enseignement supérieur dont l'entrée est soumise à la condition de réussite d'un concours, de pouvoir venir passer ce concours.
